Navigating the ever-changing landscape of U.S. immigration policies can be daunting for many seeking a new life in the States. With recent updates from U.S. Citizenship and Immigration Services (USCIS) introducing significant changes to employment authorization procedures, Temporary Protected Status (TPS) extensions, and EB-5 Regional Center audits, it’s crucial to stay informed. This blog aims to break down these updates in a clear, easy-to-understand manner, providing you with the essential information needed to manage your immigration process effectively. Whether you’re applying for a new status or adjusting your existing applications, understanding these changes is key to a successful outcome.

1. Employment Authorization for Palestinians Under DED

Starting April 1, 2024, eligible Palestinians can apply for Employment Authorization Documents (EADs) valid through August 13, 2025, under the Deferred Enforced Departure (DED). This comes after President Biden’s memorandum offering protection to certain Palestinians in the U.S. The process includes filing Form I-765 and, if needed, Form I-131 for travel documentation. Read more about this update here.

2. TPS Extension for Ethiopians

The Temporary Protected Status (TPS) for Ethiopians has been extended and redesigned. Now, approximately 12,800 additional Ethiopians are eligible to apply for TPS and its corresponding benefits until December 2025 due to ongoing conflicts and humanitarian crises in Ethiopia. This redesignation allows those who were in the U.S. as of April 11, 2024, to apply for TPS and employment authorization. Learn more about this extension.

3. EB-5 Regional Center Audits

USCIS has implemented a new auditing procedure for EB-5 Regional Centers to enhance the integrity of the EB-5 program. These audits are mandatory at least once every five years and aim to verify information and track the flow of immigrant investor capital. Non-compliance with audit procedures could lead to the termination of a regional center’s designation. Details on the EB-5 audits can be found here.

4. Adoption of DOL Definitions in USCIS Policies

USCIS has updated its policies to include the Department of Labor’s definitions of “science or art” for certain employment-based immigration applications. This change ensures consistency across federal agencies and clarifies what qualifies as exceptional ability in the sciences or arts. Read more about these policy updates.

Why This Matters

These updates are crucial for potential and current immigrants to understand as they can significantly impact the processing and outcome of various immigration applications and statuses. Staying informed helps in preparing better documentation and understanding your rights and responsibilities under U.S. immigration law.
